The National Law Center is pleased to make available a study that focuses on Mexican Customs laws and procedures as a result of NAFTA Article 303. The analysis focuses on the manner in which NAFTA Article 303 affected the Maquiladora and Pitex Industries in Mexico, among others.
The Maquiladora 2001 study is essential reading for maquiladora owners, suppliers and anyone in the export-import industry. The report is complemented by several appendices (over 1200 pages) that contain translations of current Mexican laws and regulations, including the PROSEC, Maquiladora and Pitex decrees, the Customs Law and the Customs Regulations.
The NLCIFT has continued to monitor legislative changes in Mexico relating to the implementation of Article 303 of NAFTA. Since our original Report, a number of amendments have been made to the Miscellaneous Rulings on Foreign Trade (Resolución Miscelánea de Comercio Exterior, or “RMCE”), the General Rules Implementing the Customs Provisions of NAFTA (“NAFTA Customs Rules”), and the Decree Establishing Various Sectoral Promotion Programs (the “PROSEC Decree”). The amendments do not substantially change the way the Mexican government has dealt with Article 303; rather, they are intended to lessen the administrative burden and facilitate compliance by maquiladoras and Pitex companies.
