The North American Free Trade Agreement (NAFTA) facilitates transportation services between the United States, Mexico and Canada. The efficient transportation of goods is critical to the viability of this economic region. This is particularly important because of the great distances separating population and manufacturing centers in the region.

For efficient transportation of cargo to become a reality in the region, companies must understand transportation industry practices of the participating NAFTA countries. Transportation Law and Practice in North America is a comprehensive report on the current state of the transportation industry throughout North America and describes the common practices for domestic and international shipments between the United States, Mexico and Canada. This report has been written for all knowledge levels and will assist lawyers, traffic managers and sales personnel to understand transportation issues and practices throughout the NAFTA region.

The original study, Disparities in the Law and Practice of Surface Transportation of Goods Between the United States and Mexico, was completed in the fall of 1993 for the United States Department of Transportation's Federal Highways Administration under the Intermodal Surface Transportation Efficiency Act of 1992 (ISTEA). Subsequently, all three NAFTA countries have revised their transportation laws. This revised publication reports on the current state of transportation law and practice within the NAFTA countries.

Transportation Law and Practice in North America is also the culmination of seven meetings of the North American Committee on Surface Transportation Law and Practice (NACST). NACST was created by the National Law Center for Inter-American Free Trade (NLCIFT) to address transportation issues in the NAFTA region.

NACST has been working to create the following:

1. A uniform transborder motorfreight bill of lading; 2. A uniform motor carrier liability regime for loss and damage to cargo; and 3. Uniform guidelines and rules of practice for transportation between the NAFTA countries.

Transportation Law and Practice in North America also includes the English translation of the most important Mexican transportation law and regulation: the Law of Roads, Bridges and Federal Motor Transportation, and the Regulation of Federal Motor Transportation and Auxiliary Services.

Proceeds from the sale of this publication support the NLCIFT's efforts to harmonize transportation and other trade laws and practices in the Western Hemisphere.
